The Biden Administration’s Failure to File Necessary Documents Resulted in Over 200,000 Deportation Cases Dismissed

In a shocking revelation, over 200,000 deportation cases of illegal immigrants have been dismissed due to the Department of Homeland Security’s (DHS) failure to file essential legal documents in a timely manner. This information was detailed in a recent report published by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University, as reported by the New York Post.

The TRAC report, released on Wednesday and covering data up to February 2024, shed light on a systemic issue where thousands of notices to appear (NTAs) were not filed with immigration courts before the migrants’ scheduled hearings. This failure rendered the courts unable to proceed with deportation cases and determine asylum claims.

The report highlighted the concerning trend of dismissals and emphasized the “almost total lack of transparency” on the part of DHS regarding the reasons behind these failures. The numbers speak for themselves: in 2020, 6,482 cases were dismissed due to missing NTAs, a figure that escalated to 33,802 in 2021, spiked to 79,592 in 2022, slightly decreased to 68,869 in 2023, and stood at 10,598 thus far in 2024.

Comparatively, between 2014 and 2020, less than 1% of deportation cases were dismissed due to lack of NTAs. However, the first three years of the Biden administration saw an alarming 8.4% dismissal rate for the same reason, according to The Post.
